Disability discrimination is one of the most complicated and difficult kind of case to pursue successfully. An employee must jump through a whole number of legal hurdles to prevail. The main legal concept to understand is that individuals cannot be denied employment because of their disability, as long as they are able to do the job or do it with a reasonable accommodation. So, for example, if an employee needs a special computer monitor, or an adjustment to one of their work functions, or a chair that does not aggravate a back injury, the employer will be required to provide it. Congress determined when it passed the Americans with Disabilities Act in 1990 that persons with disabilities had been traditionally excluded from the workplace and that it would no longer be tolerated.
